What New Jersey Actually Won
On August 7, 2026, the New Jersey Attorney General's office announced that a federal court had approved two settlements resolving the State's long-running PFAS litigation. Together they're valued at approximately $2.5 billion.
Here's the short version:
- The defendants are the DuPont entities, which include E.I. DuPont de Nemours (now EIDP, Inc.), The Chemours Company, The Chemours Company FC, LLC, DuPont Specialty Products USA, Corteva and DuPont de Nemours, and separately 3M.
- The DuPont share is valued at over $2 billion.
- The money covers cleanup of four DuPont industrial sites, up to $365 million to restore natural resources, and up to $795 million for PFAS abatement statewide, including drinking water.
- Attorney General Jennifer Davenport and Acting DEP Commissioner Ed Potosnak announced it.
Those are the State's own stated figures, and they're the ones worth repeating. What the announcement doesn't tell you is the part you probably care about most: whether anything changes at your kitchen sink, and when.
Does Your Tap Water Change Now?
Not because of this settlement, at least not soon.
That isn't cynicism, it's arithmetic. The State's own announcement spells out that the total settlement payments by the DuPont entities and 3M will occur annually over 25 years. This is a funding stream, not a lump sum that lands in a utility's account and buys treatment equipment next quarter.
Your water also didn't get worse on August 7. Whatever was coming out of your tap in July is what's coming out of it now. The settlement changes who pays to fix contamination over the coming decades. It doesn't retroactively change what your water system is currently delivering, and it doesn't alter the limits your utility has to meet.
So the useful question isn't "did the settlement fix my water." It's "what limit is my system actually held to, and how do I find out where it stands." That's answerable today, and we'll get to it.
How Settlement Money Reaches a Water System
This is the part that explains the long timeline.
Payments for PFAS abatement collectively total up to $795 million, and the State says that money goes out through two main channels:
- Water Bank loans. Part of the money goes into a separate, non-lapsing PFAS Abatement Fund, which the New Jersey Water Bank uses to provide loans that include no-interest, low-interest, and/or principal forgiveness for drinking water systems and publicly owned treatment works, meaning wastewater plants. At least $150 million of that Fund is committed to helping the wastewater plants.
- Direct assistance. DEP will also provide financial assistance to county, municipal and local governments and to the public, including private potable well owners, for projects that clean up PFAS contamination. That includes at least $90 million for counties to investigate and clean up PFAS at county-owned fire training academies and airports.
The channel the State describes for drinking water systems' capital upgrades is the first one, and the key word there is loans.
A water utility borrowing from the Water Bank doesn't receive a check. It applies for financing to build treatment capacity. That means engineering studies, pilot testing, design, bidding, construction and commissioning, all on a public-infrastructure schedule and all funded by money arriving in annual installments across a quarter century. Some systems will move quickly because they already had projects designed and waiting for funding. Others haven't started.
None of that is a scandal. It's how capital projects for public water systems work. Settlement money helps pay for upgrades over many years, but it isn't what decides whether your system treats for PFAS today. That depends on the New Jersey limits already on the books, and your water report shows how your system measures against them.
Which PFAS Limit Actually Governs Your Water?
This is the part a New Jersey reader can easily get backwards.
New Jersey set its limits first
New Jersey was an early mover. The state Department of Environmental Protection adopted drinking-water maximum contaminant levels of 0.014 micrograms per liter, or 14 parts per trillion, for PFOA, and 0.013 micrograms per liter, or 13 parts per trillion, for PFOS. It had already adopted a maximum contaminant level for PFNA back in 2018. At the time those rules landed, there were no federal drinking-water standards for these compounds at all.
The federal rule goes lower, but it's still phasing in
Here's the part that surprises people. The federal standard for PFOA and PFOS is 4.0 parts per trillion, with a health-based goal of zero. That's a lower number than New Jersey's 14 and 13. It is not, however, the number your utility answers to this morning.

Federal rules come with a clock. Under the PFAS rule, systems had three years to complete initial monitoring, by 2027, and five years, by 2029, to put treatment solutions in place. Until that compliance date arrives, the enforceable limit for a New Jersey utility is New Jersey's own: 14 ppt for PFOA and 13 for PFOS. The federal 4.0 ppt is where they have to land, not where they're measured today.
That distinction matters when you read your water report, because an average of, say, 9 ppt of PFOA is compliant with the standard your utility is currently held to and still above where the federal rule will eventually put it. Both things are true at once.

What happens if Washington rescinds part of the rule
On May 18, 2026, the EPA announced two proposed rules. One would keep the PFOA and PFOS limits in place while letting systems request two additional years, to 2031, to comply. The other would rescind the federal drinking-water regulations for PFHxS, PFNA and HFPO-DA, better known as GenX, along with the Hazard Index approach used for mixtures of those three plus PFBS. Those three currently sit at 10 parts per trillion each.
Both are proposals. Neither is settled law, and the outcome matters differently depending on where you live.
New Jersey adopted its own PFNA limit under state law in 2018, separate from the federal 10 ppt. A federal rescission of the federal PFNA regulation would not erase a state standard. If the proposal goes through, PFNA protection in New Jersey would rest on the state rule that's already there, which is exactly the kind of backstop the state's early rulemaking created.

How to Find Your Own Water System's PFAS Numbers
You don't have to wait for a press release to learn where you stand, and this step costs nothing.
The EPA requires community water systems to deliver a Consumer Confidence Report, also called an annual drinking water quality report, to their customers, and it has to be sent by your water supplier each year by July 1. So if you haven't looked at one since last summer, a newer one already exists. Search your utility's name plus "Consumer Confidence Report" and you'll find it, normally as a PDF. Look for the PFAS section and check three things: which compounds were tested, what the detected concentrations were, and what limit the report compares them against.
Two caveats before you draw conclusions from it:
- A system-wide report describes the system, not your specific tap. Results vary by source well, by treatment plant and by where you sit in the distribution network.
- If you're on a private well, no utility report covers your water, and PFAS doesn't announce itself. It's colorless, odorless and tasteless, so there's no way to tell by looking.

What You Can Do at Home While This Plays Out
If your report shows detections, or you're on a well and don't know, point-of-use treatment is the part of this timeline you control. Three approaches come up most often, and performance varies by product and by PFAS compound, so check a system's reduction claims for PFOA and PFOS specifically.
Reverse osmosis
Reverse osmosis pushes water through a semi-permeable membrane that rejects dissolved contaminants by size and charge. It's typically installed under the sink with a dedicated faucet. You treat the water you actually drink rather than every gallon in the house, which keeps the cost and the maintenance sane.
Carbon-based media
Activated carbon works by adsorption, meaning PFAS molecules bind to the enormous internal surface area of the media as water passes through. Contact time matters here more than most people expect, which is why cartridge size matters, and why replacement intervals aren't a suggestion. Once the media is loaded, it stops working.
Ion exchange
Ion exchange resins pull PFAS out of water by swapping them onto charged sites on the resin bead. Like carbon, it is a capacity-limited medium: once the sites are occupied, the resin has to be replaced. It comes up alongside reverse osmosis and carbon because the three work by genuinely different mechanisms, which is why a system may combine them rather than pick one.
Under-sink or whole-house
Under-sink handles drinking and cooking, which is where ingestion exposure concentrates. Whole-house treats every tap, which some households prefer for showering and bathing as well. Frequently Asked Questions
Will I get money from the settlement?
Not as a settlement payout. The settlement resolves claims brought by the State, and the money goes to site cleanup, natural-resource restoration and PFAS abatement. The abatement share moves through Water Bank loans to drinking water systems and wastewater plants, and through financial assistance DEP will provide to local governments and the public for PFAS cleanup projects. My water report says PFAS was "not detected." Does that mean there is none?
Not exactly. "Not detected" means the laboratory did not measure the compound at or above its reporting limit, which is the lowest concentration that method can report with confidence. It is not the same statement as zero. It also only covers the compounds that were actually tested, so check the list of analytes alongside the results.
I'm on a private well. Does the settlement reach me?
Possibly. The State says abatement money will fund financial assistance to local governments and the public, including private potable well owners, for projects that clean up PFAS contamination. The announcement doesn't say how to apply, so watch the New Jersey Department of Environmental Protection for program details. Private wells also sit outside the drinking-water limits discussed above, which apply to public water systems, so testing and point-of-use treatment are still the levers you hold today.
